The Return to Duty SAP Process is a series of steps that an employee has to follow to get back to work after being disqualified in a DOT test. A driver can fail the DOT (Department of Transportation Test) if he or she is tested positive on a drug test or alcohol taken by the DOT, or refuses to take any tests conducted by the DOT. The driver can return to duty after going through the steps mentioned below.

1. SAP evaluation

SAP stands for (Substance Abuse Professional) which conducts tests for the driver according to the DOT guidelines. A driver cannot refuse or step back from the test which would result in him or her being guilty. An SAP is not a company or an individual and cannot represent the employer or the employee as a lawyer. They just work for public safety and evaluate drivers who have been caught in the act.

2. Treatment or education

According to rule number 49 of DOT, an SAP has to offer treatment or education to the driver by providing aftercare services. The treatment is based on the evaluation and if the driver needs proper medication or counselors, the SAP will take care of it. After a successful treatment, the driver has to undergo an evaluation test again.

3. Second SAP evaluation

The second SAP evaluation is an important part of the DOT Return To Duty process. After the driver gets proper treatment and education from the SAP, he or she has another evaluation. After the second evaluation, the driver can return to a safety-sensitive function with or without aftercare, or even has to undergo more evaluations.

4. DOT return-to-duty Drug Testing

After the second evaluation, the SAP conducts a drug test for the driver. This drug test is required to make sure the driver is completely free from the influence of drugs and alcohol. To return to safety-sensitive positions, the driver must come up with a drug threshold of 0.02. Also, there is no need to re-hire the employee after the evaluation and drug testing.

5. Follow-up drug testing

After the driver clears the drug test, the SAP has to conduct several drug tests later to make sure that the driver is still following the rules and regulations of the DOT. These follow-up drug tests are unannounced and compulsory for the driver. The SAP can conduct a minimum of six drug tests after the evaluation and education of the employee. The employer has to track the activities and behavior of the driver too.
