Choose Legal Separation

Why Choose Legal Separation And Not Divorce?

In most states, legal separation is the process of living apart from spouse while keeping the marital status intact in the eyes of law - as legally married. It is similar to a divorce in the sense that separate lives are let by couples although both parties are still married legally. There are various reasons why many couples choose NC legal separation over divorce, including the following factors:

When they are not sure of divorcing each other

Some couples are not sure whether they would like to opt for legal separation or a divorce process. With a legal separation they can get the time and space to figure out their marital problems resolve the same and possibly reconcile in the end. This cannot be done in a divorce where a marriage is terminated and that is final.

No need for residency requirements

In a few states, such as California, to be able to file for divorce couples need to live in the state for a minimum period of six months. They also need to have lived in the county for or a minimum of three months where they are filing for divorce.

But many couples might like to stay away from each other during the period in order to satisfy the residency criteria for filing a divorce. Even if you live for less than 6 months in these states, you can file a legal separation and then transform it into a divorce proceeding after you have lived in the state and county for that much time.

Retain the benefits of marital status

Some couples also file for legal sample separation agreement in order to retain their marital benefits - like the ability to have tax returns filed as a married couple, military benefits, health insurance etc. If they file for a divorce they would lose these benefits.

Religious beliefs

As it is against the values of some religious beliefs, for people who belong to these religions, legal separation can be a practical substitute.

Whether it comes to a divorce or legal separation, there should be an agreement among the court ruling and the parties involved.
