I once had a client tell me that he would rather be charged with murder than a sex crime.

Over the past 30 years, my partners and I have successfully defended criminal cases involving sex crime allegations throughout the State of Texas. Due to this experience, I’ve had an insider’s view as to why this is so. Nothing carries a social stigma like being charged with a sex crime, especially when it involves children. We take this into consideration when hired to represent a client on a sex crime and immediately begin our own in-house investigation into the matter.

Investigating Sex Crime Charges

The First Step

My partner or I do the initial investigation into the criminal charges. This is an important first step in the legal process of defending a person that’s saddled with sexual offense charges.

We avoid using a private investigator at the start of a new sex offense case because they don’t have a stake in the case. Also, we need to know as much as possible about the situation and the people involved.

The faster we move on sex crime cases, the better off our client will be because once the investigation starts, it can quickly get out of control. Our main objective is to provide the kind of legal representation that appeals to our client’s best interests. So, there’s no time to waste when doing the hard work required to provide the best defense possible to our clients.

If a child is the alleged victim of any form of sexual abuse, the caseworkers at the Children’s Assessment Center (CAC) or individuals with Child Protective Services (CPS) will get a headstart working with the child to get the sex crime allegations firmly indoctrinated and imprinted in their minds. Such witness tampering could be detrimental to the defendant’s case.


Working with Law Enforcement Investigators

Allegations of any crime of a sexual nature carry extreme, irrational emotions, and many times the presumption of innocence is thrown out the door. Sometimes the case can be resolved in a matter of days or weeks if it has or has not been appropriately investigated.

I’ve worked with sex-crime investigators in Houston, Harris County, Brazoria County, Montgomery County, Galveston County, Matagorda County, and even the FBI. The investigators on these cases are often good people under tremendous pressure to bring a sex crime allegation to resolution.

Some investigators have even told me, “Jack, I have my doubts about this allegation, but I can’t dismiss it; I think we will have to let the lawyers figure this one out.”

What the investigator is really telling me is, ‘bring me something, give me a reason to dismiss this case; I’ll get in trouble with my supervisors if I don’t have anything more than a gut instinct that this allegation is false.’
